Return & Refund Policy – Motion Avenue

Welcome to MotionAvenue™. This Return & Refund Policy applies to all purchases made through our online store and is designed to comply with applicable South African consumer laws, including the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) and the Consumer Protection Act 68 of 2008 (“CPA”). By placing an order with Motion Avenue, you agree to this policy.
1. General Returns Policy
We want you to be satisfied with your purchase. Returns may be accepted in accordance with South African consumer protection laws and the conditions set out below.
To qualify for any return, exchange, repair, or refund request, you must:

Provide valid proof of purchase;

Contact us within the applicable return period;

Return the product in reasonable condition;
-
Include all accessories, cables, manuals, and packaging where reasonably possible.
Motion Avenue reserves the right to inspect returned products before approving a refund, repair, or replacement.
2. Defective, Damaged, or Faulty Products
In terms of Sections 55 and 56 of the Consumer Protection Act, customers are entitled to goods that are safe, durable, and reasonably suitable for their intended purpose. (DML)
If your portable charger, flashlight, or any other product purchased from Motion Avenue is defective, damaged, unsafe, or not functioning correctly under normal intended use, you may return it within 6 months of delivery. (LekkerLaw)
After inspection and confirmation of the fault, Motion Avenue may, at its discretion where permitted by law:

Repair the product;
-
Replace the product; or
-
Refund you in full.
Motion Avenue reserves the right to first assess and test the product to confirm the reported defect before issuing a refund, repair, or replacement.
The following are NOT regarded as defects:

Damage caused by misuse, abuse, negligence, liquid damage, power surges, improper charging, or unauthorized modifications;

Normal wear and tear;
-
Cosmetic damage that does not affect functionality;
-
Damage caused by failure to follow product instructions;
-
Damage caused by commercial or industrial use outside normal consumer use.
Products returned that are found to be fully functional and not defective may be returned to the customer at the customer’s expense.
3. Incorrect Products or Shipping Damage
If you receive:

The wrong item;
-
An item missing parts; or
-
A product damaged during delivery,
you must notify Motion Avenue within 48 hours of delivery.
We may request photos or supporting evidence before arranging collection, replacement, store credit, or refund.
4. Cooling-Off Period for Online Orders
Under Section 44 of the ECTA, customers who purchase products online may cancel the transaction within 7 days after receiving the goods, without needing to provide a reason.
To qualify:

The product must be unused and in substantially the same condition received;
-
All packaging, accessories, and manuals should be included where reasonably possible;
-
The customer is responsible for direct return shipping costs unless the item was defective or supplied incorrectly.
Once the returned item is inspected and approved, refunds will be processed within 7-10 business days.
5. Change-of-Mind Returns
Except where required by law, Motion Avenue is not obligated to accept returns for:

Buyer’s remorse;
-
Incorrect product choice;
-
No longer wanting the item;
-
Price changes after purchase. (FHBC)
If Motion Avenue chooses to accept a non-defective return as a goodwill gesture:

A handling or restocking fee may apply;
-
Original delivery fees are non-refundable;
-
The item must be unopened, unused, and in resellable condition.
Motion Avenue reserves the right to refuse any change-of-mind return request.
6. Non-Returnable Items
For hygiene, safety, and quality-control reasons, the following may not be returned unless defective:

Used products;
-
Products with tampered serial numbers;
-
Items damaged after delivery;
-
Products altered or repaired by unauthorized third parties;
-
Clearance, final-sale, or promotional items marked as non-returnable where legally permitted.
7. Refund Processing
Approved refunds will be processed back to the original payment method where possible.
Motion Avenue may refuse refunds where:

Fraudulent activity is suspected;
-
The returned item differs materially from what was supplied;
-
The product has been intentionally damaged;
-
The return does not comply with this policy or applicable law.
Bank processing times may vary depending on your financial institution.
8. Warranty Limitations
Any manufacturer warranty applies in addition to your rights under South African consumer law.
To the fullest extent permitted by law:

Motion Avenue shall not be liable for indirect, incidental, or consequential damages;

Liability is limited to the purchase price paid for the product;
-
Customers are responsible for backing up or protecting any connected devices before use of charging products.
9. Return Process
To request a return:

Email us at russell@motionavenue.co.za with your order number and reason for return;

Wait for return authorization instructions;
-
Package the item securely to avoid transit damage;
-
Send the item using the approved return method.
Motion Avenue may refuse parcels returned without prior authorization.
10. Consumer Rights
Nothing in this policy limits or removes any rights you may have under South African law, including the Consumer Protection Act or Electronic Communications and Transactions Act. (LekkerLaw)
If a dispute cannot be resolved directly with Motion Avenue, customers may contact the National Consumer Commission or the Consumer Goods and Services Ombud.
